Terms of Service

These terms govern your use of Nocturn ("we," "us," "our") and the membership services we provide. By subscribing to Nocturn or using getnocturn.app, you agree to these terms.

1. What Nocturn Is

Nocturn is a paid membership that provides access to complimentary drinks at participating partner bars, along with information about events and specials at those venues. Nocturn is not a bar, restaurant, or alcohol retailer — we do not sell, serve, or deliver alcohol. All drinks redeemed through Nocturn are served by our licensed partner venues, who are solely responsible for the sale and service of alcohol, including age verification and responsible service.

2. Eligibility

You must be 21 years of age or older to subscribe to Nocturn. By creating an account, you confirm that you meet this requirement. Our partner venues are responsible for verifying age at the point of service, as required by law.

3. Membership & Billing

• Nocturn membership is $20 per month, billed on a recurring basis through Stripe.
• Your membership includes a limited number of complimentary drink credits per week, as described on our website at the time of purchase. Credits do not roll over and reset on a weekly basis.
• You may cancel your membership at any time. Cancellation takes effect at the end of your current billing period; we do not provide partial refunds for unused time or credits.
• We reserve the right to change membership pricing or perks with reasonable notice to active subscribers.

4. Drink Redemption

• Complimentary drinks are limited to selected options at participating venues and are subject to change.
• Credits are non-transferable and may only be redeemed by the account holder.
• We reserve the right to limit, suspend, or terminate an account if we reasonably suspect fraud, abuse, or misuse of the membership (including sharing login credentials or attempting to redeem credits fraudulently).
• Participating venues may decline service to any individual in accordance with their own policies and applicable law, including refusal of service to intoxicated individuals.

5. Responsible Use

Nocturn promotes responsible enjoyment of our partner venues. We do not encourage excessive alcohol consumption. Drink limits exist in part to support responsible use. If you choose to drink, please do so responsibly and never drive under the influence.

6. Account Responsibility

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately at nocturnapp2025@gmail.com if you suspect unauthorized use of your account.

7. Partner Venues

Nocturn partners with independently owned and operated bars and venues. We are not responsible for the conduct, safety, service quality, or policies of any partner venue. Your interactions with partner venues, including the consumption of alcohol, are at your own risk and subject to that venue's own policies.

8. Limitation of Liability

Nocturn is provided "as is" without warranties of any kind. To the fullest extent permitted by law, Nocturn and its founders are not liable for any indirect, incidental, or consequential damages arising from your use of the service or your visits to partner venues.

9. Changes to These Terms

We may update these terms from time to time. Continued use of Nocturn after changes take effect constitutes acceptance of the revised terms.
